Vested Right Special Use Permit

Subject

Extension of Application Deadline for Vested Rights Special Use Permits.

Purpose

To provided a one year time extension for submitting an application for a Vested Rights Special Use Permit to property owners who are adversely affected by Section 3.5.3.4.2 (Protection of Upland Habitat) of the land Development Code, but who would otherwise be prohibited from submitting an application due to the time limitations set forth in Section 1.7.2.3 of the Land Development Code. Such a policy is authorized by Section 1.7.2.5 of the Land Development Code, which allows the Board of County Commissioners to grant an extension of the application period in order to avoid undue hardship.

Policy

It is the policy of the Board of County Commissioners to allow property owners who are adversely affected by Section 3.5.3.4.2 (Protection of Upland Habitat) of the Land Development Code to submit an application for a Vested Rights Special Use Permit for a period of one year after the effective date of the Land Development Code, allowing applications to be made on or before May 1, 1993.

Responsibilities

It is the responsibility of the Planning and Development Management Department to implement this policy as approved and adopted by the Board of County Commissioners.
