Payment by Petitioner to the County for Improvements in Right of Way Being Vacated
Purpose
The authorize a reimbursement fee for County improvements within any right of ways being vacated.
Policy
The Board of County commissioners approves and authorizes a fee for the reimbursement of improvements made by the County within any right of ways being vacated. Fee shall be fair current value of the improvements and shall be computed based on the cost and condition of the improvements, depreciation, and other relevant factors. An estimate of said fees shall be provided to the potential petitioner prior to their filing a vacating petition with the Real Estate Department.
Responsibilities
The Road, Bridge, Traffic and Inspection Department is responsible for calculating the reimbursement fee based on the above stated factors and will provide a written statement detailing said calculations to the potential petitioner prior to their filing a vacating petition. A copy of said statement shall be attached to the petition when filed with the Real Estate Department.
The reimbursement fee shall be submitted to the Real Estate Department prior to the public hearing for the vacating. In the event the vacating is denied, a refund of said reimbursement fee will be processed.
