Policy for Performance and Payment Bond on Construction Projects Not Exceeding $100,000
Purpose
To align Board of County Commissioners’ Policy with amended Florida Statute 255.05 which extends discretion to local government units on construction projects where cost of project is less than $100,000 to be exempt from requiring a performance and payment bond.
Policy
The Board of County Commissioners’ policy is to provide consistency and optimum competition in all bid matters and to consider each bid separately, pertinent to the department’s request, along with the concurrence of the administrative staff for waiver of the requirements for a performance and payment bond prior to advertising for bids.
Responsibilities
It is the responsibility of the sponsoring department and the administrative staff when presenting to the Board of County Commissioners a construction project estimated to be less than $100,000 to provide complete documentation for recommendation of waiver of the requirement for a performance and payment bond propr to advertising for bids.
